Buckley Kolar LLP focuses its practice on the financial services industry with deep experience in mortgage lending, credit cards, and consumer finance generally. As the subprime crisis expands, many law firms look to us for our expertise in these industries to help them deal with critical matters, including reorganizations, bankruptcy filings, mergers and acquisitions, class action lawsuits and civil and criminal government investigations. We are regularly retained as special counsel by other law firms in connection with:
- Investigations and litigation related to mortgage and consumer credit, including identification and preparation of expert witnesses;
- Due diligence associated with acquisitions of mortgage and consumer finance companies and loan portfolios;
- Portfolio reviews to identify risk and determine valuation, including coordinating legal, financial and econometric modeling professionals;
- Obtaining licenses, charters and change of control approvals from federal and state consumer credit and banking agencies for private equity firms, hedge funds and other investors;
- Advising on the set up of loan origination and servicing platforms in compliance with state and federal regulatory requirements (RESPA, TILA, FCRA, FDCPA, FHA, BSA, UDAP, etc.)
- Legislative and regulatory representation, including assistance in negotiating with regulators and law enforcement personnel. Our legal personnel are regularly in contact with state and federal regulators and in many cases have experience serving as counsel to regulatory agencies or the Congress.
