Firm News 2008

  • Jeremiah Buckley, Margo Tank, and Lane Macalester spoke at the Managing Electronic Records (MER) Conference on May 20 in Chicago, Illinois. Their panel entitled, "Legal Considerations for Conducting Business Electronically: Practical Guidance," focused on how the Electronic Signatures and Global and National Commerce Act (ESIGN) and the Uniform Electronic Transactions Act (UETA) now make it possible to present and store information and to sign agreements electronically in circumstances where, in the past, paper documents and wet signatures would have been required. Mr. Buckley, Ms. Tank, and Ms. Macalester discussed the new challenges presented and provided practical guidance to the industry. A copy of the PowerPoint presentation is available here.
  • Jeffrey Naimon spoke at the Mortgage Banker’s Association’s Legal Issues and Regulatory Compliance Conference held April 28-May 1, 2008 in Carlsbad, CA.  Mr. Naimon’s speech was entitled, “The Rise and Fall (Hopefully) of the Disparate Impact Theory of Fair Lending Liability.”

  • Buckley Kolar has been listed as a GO TO Law Firm for Regulatory Affairs and Compliance issues in a 2007 magazine entitled “In-House Law Departments at the Leading Financial Services Companies.”  The article can be found on page 134 of the magazine from the publishers of Corporate Counsel.

  • Jerry Buckley and Joe Kolar participated in a panel entitled “RESPA Compliance and Enforcement: Dealing with the Challenges” along with Gary M. Cunningham, Deputy Assistant Secretary of HUD and Peter S.   • Margo Tank was part of an audio conference entitled Evidence Requirements for Electronic Signatures on May 15th, 2007. The seminar covered current trends in e-signatures and records and the processes used to create them. Mrs. Tank and representatives from Silanis discussed how, as more and more processes are brought online, organizations must take steps to ensure their mission-critical processes and transactions continue to be legally enforceable.   • Frank Supik spoke at the Equipment Leasing and Finance Association’s Legal Forum in Miami, Florida on May 7. Mr. Supik participated in a panel discussion entitled “Doing Deals in a Paperless Society (Electronic Chattel Paper).   • Buckley Kolar announced the opening of its Los Angeles Office on May 2nd, 2007. The office is located at 2029 Century Park East Suite 900, Los Angeles, CA 90067.   • Andrea “Lee” Negroni attended the Third Annual International Conference of the Information Technology Law Association in Bangalore, India during the month of February 2007. She and Buckley Kolar partner John Kromer have been assisting clients with legal issues in the area of business process outsourcing (BPO) for U.S. and India-based financial institution clients.  During her trip, Lee posted a periodic "Blog from Bangalore".

  • Andrea “Lee” Negroni and Joe Lynyak spoke at two Thomson/West users’ conferences in Los Angeles and Santa Ana, California on February 6th and 7th, 2007. They discussed topics in residential and commercial mortgage lending, data security and consumer financial privacy laws, fair lending, firm offers of credit and FCRA, and RESPA enforcement.   • Robert Serino gave an audio conference entitled “Best Practices in BSA and AML Compliance” on February 6th, 2007. Mr. Serino addressed several topics on establishing and maintaining a Bank Secrecy Act (BSA) compliant anti-money laundering (AML) system.   • On January 29, 2007 the Mortgage Bankers Association announced the release of a policy paper entitled "Suitability--Don't Turn Back the Clock on Fair Lending and Homeownership Gains." The paper discusses the consequences of imposing a "suitability standard" similar to that used in the securities industry on the mortgage lending industry.  Buckley Kolar attorneys Jeremiah Buckley, Frederic Spindel, Jon David Langlois and Anastasia Davis provided legal assistance in the preparation of this paper.
