Practice

Jeff Naimon is a partner of Buckley Kolar LLP. Mr. Naimon focuses his practice on regulatory, transactional and legislative advice to a variety of financial services providers, including banks, mortgage and consumer finance lenders, servicers, insurers, and investors, and various ancillary service providers.

Mr. Naimon counsels financial institutions and their affiliates on their consumer finance operations, combining in-depth knowledge of consumer protection laws, banking law, general commercial law and business operations. His practice includes providing general regulatory advice, assisting with structuring operations, performing specialized regulatory due diligence on acquisition targets, and negotiating transactions (including mergers and acquisitions, joint ventures, private label agreements, electronic commerce agreements and vendor contracts) in the consumer financial services area; providing advice on fair lending issues and investigations; drafting and reviewing consumer disclosures; drafting legislative or regulatory language or advocacy papers; and responding to governmental inquiries and enforcement proceedings.

Mr. Naimon advises on the entire panoply of banking and consumer finance statutes, including the National Bank Act, the Home Owners' Loan Act, the Truth in Lending Act, the Real Estate Settlement Procedures Act, the Fair Credit Reporting Act, the Equal Credit Opportunity Act, the Fair Housing Act, the Fair Debt Collection Practices Act, the privacy provisions of the Gramm-Leach-Bliley Act, the E-Sign Act, and state laws governing lending, servicing, collections and unfair and deceptive acts and practices.

Professional Activities

Mr. Naimon is a member of the Consumer Financial Services Committee of the American Bar Association's Section of Business Law. Mr. Naimon is also a member of the District of Columbia Bar Association.

Publications/Presentations

Mr. Naimon is the principal author of "Assignee Liability in Residential Mortgage Transactions" published in the March 2003 issue of The Review of Banking and Financial Services and the co-author of the chapter "Transactions Involving Real Estate and Dwellings" in the 2000 edition of Rohner and Miller's treatise, Truth in Lending (© 2000 American Bar Association). He has been a co-chair of the American Conference Institute's conferences on outsourcing in the financial services arena and he regularly speaks on a wide variety of consumer financial services topics.
